1. Basis of Contract and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. By booking with Bazenga Safaris and Wild Expeditions, all passengers agree that the courts of Kenya shall have exclusive jurisdiction over any dispute or claim arising from the booking.

Acceptance
Payment of a deposit or submission of a signed booking form constitutes a binding contract and unconditional acceptance of these Terms and Conditions by the Lead Passenger on behalf of all persons included in the booking.

2. Booking, Deposit, and Final Payment
A non-refundable deposit of 30% of the total trip cost is required within 7 days of the invoice date to secure a booking, unless otherwise stated for special permits or high-demand expeditions.

Final Payment
The remaining balance must be paid no later than 60 days before departure. Bookings made within 60 days of departure require full payment immediately upon confirmation.

3. Cancellations and Refunds
All cancellations must be submitted in writing. Cancellations made 90+ days before departure will forfeit the deposit only, while cancellations made closer to departure may attract penalties of up to 100% of the total trip cost.

Non-Refundable Permits
Gorilla trekking permits, chimpanzee permits, and selected luxury lodge deposits remain 100% non-refundable regardless of the notice period provided.

4. Changes and Surcharges
Bazenga Safaris and Wild Expeditions reserves the right to revise trip prices up to 30 days before departure due to fluctuations in currency exchange rates, government taxes, park fees, or significant fuel increases.

Itinerary Flexibility
African overlanding requires flexibility, and routes, accommodations, or transport arrangements may change without prior notice due to weather, local conditions, mechanical issues, or political situations.

5. Force Majeure & Agency Cancellation
Force Majeure includes events beyond reasonable control such as natural disasters, border closures, pandemics, civil unrest, industrial disputes, or acts of terrorism that may affect scheduled departures.

Company Rights
In the event of cancellation caused by Force Majeure, the Company may provide a travel credit voucher for the recoverable portion of the trip or offer an alternative departure date instead of a cash refund.

6. Client Responsibility and Health
Comprehensive travel insurance covering emergency medical evacuation, repatriation, trip cancellation, and baggage loss is mandatory for all travelers before departure.

Documentation & Conduct
Clients are solely responsible for valid passports, visas, transit permits, and health certificates required for travel. The Company reserves the right to remove any traveler whose conduct threatens group safety or well-being.

7. Limitation of Liability
Overlanding and adventure travel involve inherent risks including remote travel, wildlife encounters, unpredictable weather, and limited medical facilities. By joining the expedition, travelers voluntarily accept these risks.

Waiver & Maximum Liability
Bazenga Safaris and Wild Expeditions acts as an agent for third-party suppliers and shall not be held liable for injury, loss, delay, or damage caused by third parties or circumstances beyond direct control. Maximum liability is limited to the total amount paid for the trip.

Final Checklist for Implementation
Ensure these Terms and Conditions are clearly linked on the website footer and booking forms, and include a mandatory acceptance tick-box during the booking process.

Insurance Audit
Always collect travel insurance policy numbers and 24-hour emergency contact details from all guests before departure to ensure safety and emergency preparedness.
